This document (“Terms of Service”, “TOS”) controls the usage of hosting services provided by Nemea (“us”, “we”, “Nemea”). By using our services, you agree to comply with these Terms of Service.
1. Age Restrictions
By using Nemea, you confirm you are at least 13 years of age — if you are under this age, you are forbidden from using our services.
We reserve the right to request evidence of your age to comply with our age restrictions.
If you are under the age of 18, but above the age of 13, you are only permitted to use our services with the supervision of a legal guardian who agrees to these Terms of Service.
Violations of these age restrictions will result in the termination of your account and service.
2. Account Security
You are responsible for withholding the credentials of your Nemea account. You will immediately contact Nemea upon any unauthorised use.
You are responsible for activities that occur under your account email or username. Nemea is not liable for any damages caused by negligence or failure to comply.
3. Service Restrictions
You will use Nemea’s services while complying with any applicable laws and these terms.
You will not engage in activities that may degrade the functioning of Nemea’s networks or services.
4. Payments and Refunds
We offer both free and paid hosting services. Free accounts have no access to refunds or Service Level Agreement compensation provided to paid users.
Paid users agree to pay the fees and charges associated with the plan chosen. Payment information, including the billing cycle and payment methods, will be shown during the purchase process.
EU Consumer Law states that consumers have a 14 day right of refunds for purchases. This does not apply to services once performance has begun with the customer’s consent and acknowledgement that they lose the right of withdrawal once begun. By using our infrastructure after purchase, you acknowledge the withdrawal right does not apply.
An initial purchase is the first payment made toward a specific paid Nemea service. This payment activates the service on your account. Any later payments for the same service, including renewals or extensions, are not considered initial purchases.
You may request a full refund within 48 hours of activation following your initial purchase. This refund will be issued to your original payment method. No reason is required.
After the first 48 hours and up to 14 days from activation, refunds are only available if you experience a persistent infrastructure fault caused by Nemea that prevents reasonable use of the service, and we are unable to resolve the issue within a reasonable timeframe.
Renewal payments, plan extensions, and any subsequent charges for a service you already hold are not eligible for refunds to your original payment method.
In some cases, Nemea may offer prorated account credit for subsequent payments, such as early cancellation or service changes. Account credit is optional, cannot be converted to cash, and may expire if unused.
After the initial 48 hour period, refunds are not available for issues caused by user configuration, code, workload, or third party dependencies; violations of these Terms; scheduled or emergency maintenance; non refundable add ons or pass through fees; services already cancelled by the user; or any renewal or subsequent payments.
To request a refund within the 48 hour period, open a ticket at nemeahosting.com/panel/tickets. For 14 day refund requests, include logs or evidence showing the infrastructure fault.
Approved refunds for initial purchases will be issued to the original payment method where possible and may be adjusted to account for non recoverable fees. Compensation for subsequent payments is issued only as account credit.
Nemea may decline or revoke refunds or credits in cases of misuse, fraudulent activity, excessive chargebacks, or violations of these Terms.
5. Content and Intellectual Property
You will not host or transmit content that is illegal, infringing, obscene, defamatory, or violates the rights of any third party.
Nemea may remove or suspend any content that violates these terms or infringes upon the rights of others.
Nemea may review hosted content if it appears suspicious or potentially in violation of these terms.
You agree to cooperate with any content review initiated by Nemea.
Nemea may take action, including removal or suspension of content, based on the outcome of its review.
6. Website Review and Security Monitoring
Nemea automatically reviews hosted websites using software that may include artificial intelligence to ensure no phishing, malware, or harmful content is hosted.
Automated systems may analyse URLs, file structures, and content to identify potentially harmful or illegal material.
If automated or manual review identifies content that violates these terms or poses a security risk, Nemea may immediately suspend or terminate the service.
Hosting prohibited content, including phishing websites or malware, will result in permanent suspension and may be reported to authorities.
Nemea will cooperate with law enforcement when required or when necessary to protect users, the platform, or the public.
By using Nemea, you consent to automated review and understand that violations may result in permanent suspension and legal consequences.
7. Disclaimer of Warranties
Nemea provides its services on an “as is” and “as available” basis without warranties of any kind.
Nemea does not guarantee uninterrupted or error free service.
8. Limitation of Liability
Nemea is not liable for any direct, indirect, incidental, consequential, or special damages arising from use of its services.
Nemea’s total liability is limited to the amount paid by you for services during the six months preceding the event giving rise to liability.
9. Termination
Either party may terminate services at any time, with or without cause, by providing written notice.
Upon termination, Nemea may delete all your data and you will lose access to the services.
10. Modifications
Nemea may modify or update these Terms at any time. Changes take effect once posted.
Continued use of Nemea after modifications means you accept the updated Terms.
